Quadri Kasali, a danfo driver who is on trial for trying to knock down a judge has being in detention for over five months and was again denied any reprieve as his trial lasts.
The 33-year-old driver, has been detained in Ikoyi Prison since April and still has to spend more time in custody as the Magistrate Court sitting in Tinubu Square, Lagos Island on Monday said it is still awaiting the advice of the state Director of Public Prosecution (DPP) on the matter.
In the five count charge slammed against Kasali, he is alleged to have driven his vehicle on Moloney Street, Lagos Island in a deliberate manner with intent to kill the Honourable Justice Adeniyi Adebajo of the Lagos High Court.
At the last sitting of the court on the 13th of August, the danfo driver’s plea to the charges could not be taken as Magistrate Adegbite held that she lacked jurisdiction on the matter.
He was therefore ordered to be remanded in Ikoyi Prison for one month to enable the prosecution obtain the DPP’s advice.
At the resumed hearing of the matter on Monday, the prosecutor told another magistrate who sat in for Magistrate Adegbite who is on vacation that he had only just sent the case file to the DPP on the 30th of July and was yet to obtain the advice.
The Magistrate hearing the case refused to entertain the application for bail brought by counsel to Kasali, Mr. Adedotun Isola-Osobu from the law firm of Falana and Falana.
Outside the court, Isola-Osobu told Channels Television that he would be relying on Section 119 of the Administration of Criminal Justice Law of Lagos to approach the Lagos High Court to seek bail for his client.
Meanwhile, the Magistrate has adjourned the case till the 13th of September to continue to await the advice of the DPP on the prosecution of Kasali the danfo driver.
